The Surface Mining Control and Reclamation Act (SMCRA) is the primary environmental law governing coal mining and reclamation activities. This law requires that all coal mining related land disturbances should be minimized while maximizing coal recovery. The Federal Office of Surface mining (OSM) has an oversight role in the states in which we operate, with each state having their own regulatory program.
The West Virginia Department of Environmental Protection (WVDEP) regulates our coal mining and reclamation operations. We are a member of the WV Coal Association and actively participate on the Environmental and Technical Committee.
The PA Department of Environmental Protection regulates our PA operations. We are active members of the PA Coal Association.
We are regulated by the KY Department of Natural Resources, and we are active members of the KY Coal Association.
We are regulated by the VA Division of Mined Land Reclamation (VADMLR). We are active members of the Virginia Coal Association and the Virginia Mining Association.
We are also a very active member of the National Mining Association and a participant on the Environmental Committee.
In addition, our mining operations abide by a number of other federal environmental laws include:
Clean Water Act (CWA)
Clean Air Act (CAA)
Solid Waste Disposal Act (SWDA)
Safe Drinking Water Act (SDWA)
Comprehensive Environmental Response, Compensation and Liability Act (CERCLA)
Toxic Substances Control Act (TSCA)
Resources Conservation and Recovery Act (RSRA)
National Environmental Policy Act (NEPA)
Endangered Species Act (ESA)
